REPRESENTATIVE MATTERS

  • Obtained a $1.4 million arbitration award against Pepper Lawson general contractors represented by Andrews Myers before a Houston AAA Construction Industry Panel on behalf of a national concrete shell contractor, completely defeating Pepper Lawson's counterclaims and with a reasoned award finding no delay to the project on the part of the firm's client.

 

  • Obtained a $2 million pre-litigation mediated settlement for Energy Transfer Partners against general contractor that terminated operations and abandoned remaining pipeline construction work. The settlement was achieved notwithstanding contractor's claims of no assets and with no offers of settlement before mediation.

  • Obtained a $5 million verdict for Energy Transfer Partners in Harris County District Court against contractor for breach of contract and defeated contractor's counterclaims alleging that pipe provided by company was defective.

  • Successfully represented prominent Miami business owner in a shareholder dispute, resulting in a post-arbitration settlement redeeming the adverse shareholder's interest at a substantially discounted amount and providing the client approximately one million dollars in realized gains.

 

  • Represented top ten national contractor in highly complex construction licensing issues case, resulting in the overturning of an adverse summary judgment ruling and preservation of claims valued over $25 million.

 

  • Represented leading national LNG tank construction company in arbitration relating to over $20 million in claims, successfully defeating summary judgment efforts and preserving claims for exemplary damages and attorneys' fees.

 

  • Obtained summary judgment disposing of $15 million performance bond claim based on obligee's denial of surety cure rights after contractor's predecessor counsel filed motion on different grounds, resulting in denial of summary judgment and substantial exposure.

 

  • Successfully settled highly complex construction dispute relating to prominent mixed-use retail and residential construction project at a small fraction of full value, terminating potential $50 million exposure to one of the nation's largest general contractors.
